Terms of Service

Version 2026-09-24

Effective date: September 24, 2026
Last updated: September 24, 2026

These Terms of Service ("Terms") are a legal agreement between you and The Widget Bot LLC, a Michigan limited liability company ("Widget Bot," "we," "us," or "our"), doing business as Turnout. Widget Bot is owned by Netrork LLC, a Michigan limited liability company. These Terms cover your use of the Turnout website, web application, and related services (together, the "Service").

By creating an account, creating a Show, applying to a Show, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use Turnout on behalf of an organization, such as a market, festival, association, nonprofit, or business, you are agreeing on behalf of that organization and you confirm you have authority to do so. In that case, "you" means the organization.

If you do not agree to these Terms, do not use the Service.

The Short Version

This summary is here to help you understand the Terms. It is not a substitute for them. If anything in this summary conflicts with the full Terms, the full Terms control.

  • Turnout is software. We give organizers tools for vendor applications, jurying, booth assignments, payments, and communication. We do not run events, and we are not a party to any agreement between an organizer and a vendor.
  • Organizers make all decisions about their shows, including who gets accepted, where vendors are placed, what fees are charged, and refunds and cancellations.
  • Payments are processed by Stripe. Organizers receive vendor payments through their own Stripe account.
  • Turnout does not charge vendors a fee to apply to shows.
  • You own the content you upload. You give us permission to use it only to run the Service.
  • We can suspend accounts or shows that appear fraudulent or that break these Terms.

1. Definitions

  • "Show" means any event managed through the Service, including art fairs, craft shows, farmers markets, festivals, and recurring markets. For recurring markets, each market day may be treated as part of the Show.
  • "Organizer" means a person or organization that uses the Service to create or manage a Show, including any team members the Organizer invites to its account.
  • "Vendor" means an artist, crafter, maker, farmer, food vendor, exhibitor, or other person or business that creates a profile or applies to a Show through the Service.
  • "Juror" means a person an Organizer invites to review or score applications.
  • "User" means anyone who uses the Service, including Organizers, Vendors, and Jurors.
  • "User Content" means anything submitted to the Service by a User, including text, images, profiles, applications, Show listings, maps, messages, and reviews.
  • "Organizer Fees" means fees an Organizer charges Vendors, such as application fees and booth fees.
  • "Turnout Fees" means the fees we charge Organizers for the Service, as described in Section 6.

2. Eligibility and Accounts

2.1 Age. You must be at least 18 years old and able to form a binding contract to create an account. A Vendor under 18 may participate only through an account created and controlled by a parent or legal guardian, who agrees to these Terms and is responsible for all activity on that account.

2.2 Accurate information. You agree to provide accurate and complete information and to keep it up to date.

2.3 Account security. You are responsible for keeping your login credentials secure and for all activity under your account. Do not share your login. Notify us promptly at support@betterturnout.com if you believe your account has been accessed without permission.

2.4 Team members and Jurors. Organizers may invite team members and Jurors to access their account or Shows. The Organizer is responsible for the actions of everyone it invites and for removing their access when it is no longer appropriate.

2.5 Legal restrictions. You may not use the Service if you are barred from doing so under the laws of the United States or any other applicable jurisdiction.

2.6 United States only. The Service is offered only to people and organizations located in the United States, and only for Shows held in the United States. You may not create an account or use the Service from outside the United States. We may refuse, suspend, or close any account that does not meet this requirement.

3. What Turnout Is and Is Not

3.1 We provide software tools. Turnout provides tools that help Organizers and Vendors manage Shows. Widget Bot is not an event organizer, promoter, venue, landlord, employer, agent, broker, or payment processor. We are not a party to any agreement between an Organizer and a Vendor, Juror, attendee, sponsor, or anyone else.

3.2 Organizers make the decisions. Each Organizer alone decides:

  • which Vendors are accepted, waitlisted, or declined;
  • jury criteria, scoring, and who serves as a Juror;
  • booth locations, sizes, and assignments, including assignments that change from one market day to the next;
  • fees, deadlines, refund policies, and cancellation policies; and
  • Show rules and requirements.

We do not review, approve, or guarantee any of these decisions and are not responsible for them. Vendors with questions or disputes about a decision should contact the Organizer directly.

3.3 No guarantees about Shows or Vendors. We do not guarantee that any Show will take place as described, attract attendees, generate sales, or be run lawfully or safely. We do not guarantee that any Vendor will be accepted, show up, or perform as promised, or the quality, safety, or legality of any product sold at a Show. Weather, cancellations, postponements, venue changes, and anything that happens on-site are between the Organizer and its Vendors.

3.4 Verification features. We may offer features such as verified badges or Show verification. These reflect only the limited checks described in the Service at the time. They are not an endorsement or a guarantee of anyone's identity, legitimacy, or conduct. Always use your own judgment before paying for or participating in a Show.

3.5 Dealings outside the Service. Anything that happens outside the Service, including payments sent outside Turnout, side agreements, and conduct at a Show, is solely between the people involved.

4. Organizer Terms

4.1 Your Shows, your responsibility. You are responsible for your Shows and for following all laws that apply to them. This includes permits, licenses, venue agreements, health and food safety rules, insurance, accessibility requirements, sales and use tax, consumer protection laws, and anti-discrimination laws.

4.2 Accurate listings. Your Show information must be accurate and not misleading, including dates, location, fees, deadlines, number of available spaces, refund policy, and selection process. If something changes, update your listing promptly and notify affected Vendors.

4.3 Your policies. You must make your refund, cancellation, and Show rules available to Vendors before they pay, and you must honor them. We recommend including them in your Show listing.

4.4 Lawful selection. You are responsible for making sure your selection process is lawful. You may not use the Service to discriminate against anyone on the basis of any characteristic protected by law.

4.5 Vendor information. When Vendors apply to your Show, you receive their information. You agree to:

  • use it only to run and communicate about your Shows;
  • keep it reasonably secure and not sell it;
  • follow applicable privacy and anti-spam laws; and
  • not use application questions to collect Social Security numbers, full bank account numbers, payment card numbers, or other sensitive information you do not need and are not legally allowed to collect.

Once you export or download Vendor information from the Service, you are solely responsible for it.

4.6 Messages. You are responsible for messages you send through the Service. Any marketing messages you send must comply with anti-spam laws, including the CAN-SPAM Act, and must honor unsubscribe requests.

4.7 Real events only. You may only list real Shows that you have the authority to run. We may ask for information to verify you or your Show, such as a website, event history, venue details, or the identity of the person responsible. Until verification is complete, we may limit features, restrict payment collection, or pause your Show.

5. Vendor Terms

5.1 Accurate applications. Information and images you submit must be accurate and must represent your own work or products, or work you are authorized to sell, as required by the Show's rules.

5.2 Your business obligations. You are responsible for your own permits, licenses, sales tax collection and reporting, insurance, and compliance with the Show's rules and the law.

5.3 Your agreement is with the Organizer. When you apply to a Show, pay Organizer Fees, or accept a booth, your agreement is with the Organizer, not with Widget Bot. Questions about acceptance, refunds, booth placement, cancellations, or other disputes should go to the Organizer.

5.4 No fee from us to apply. Turnout does not charge Vendors a platform fee to apply to Shows. Organizers set their own application and booth fees. Those fees, and any applicable taxes, are shown before you pay.

6. Fees and Payments

6.1 Turnout Fees. Organizers pay us:

  • Platform Fee: a percentage of Organizer Fees paid through the Service (currently 5%), deducted automatically when each payment is processed; and
  • Add-on Fees: fees for optional features an Organizer chooses to purchase, as described at checkout.

Creating Shows, listing them, receiving applications, and collecting Organizer Fees do not require an add-on and carry no separate charge. We may change our pricing going forward with notice. A change to the Platform Fee will not apply to payments already processed, and a change to add-on pricing will not affect an add-on you have already purchased.

6.2 Billing. Add-on Fees are charged to the payment method on your account. The Platform Fee is deducted automatically as each Vendor payment is processed. You authorize us and our payment processor to charge that payment method. Turnout Fees do not include taxes, and you are responsible for any applicable taxes other than taxes on our income.

6.3 No account limits. We do not limit the number of Shows you run, market days you schedule, or Vendors you accept.

6.4 Refunds of Turnout Fees. Add-on Fees are non-refundable once purchased, except where required by law or where we withdraw an add-on for a reason other than your violation of these Terms. If you have a question about a charge, contact us at support@betterturnout.com. The Platform Fee is not returned when you refund a Vendor, unless required by law.

6.5 Payment processing by Stripe. Payment processing services for Organizers on Turnout are provided by Stripe, Inc. and are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (together, the "Stripe Agreement"). By agreeing to these Terms or continuing to operate as an Organizer on Turnout, you agree to be bound by the Stripe Agreement, as Stripe may modify it from time to time. As a condition of Turnout enabling payment processing through Stripe, you agree to provide us with accurate and complete information about you and your business, and you authorize us to share that information and transaction information related to your use of Stripe's payment processing services.

6.6 We do not hold funds. Organizer Fees paid by Vendors are processed by Stripe and paid out to the Organizer's connected Stripe account. Widget Bot is not a bank, money transmitter, or escrow service and does not hold Vendor or Organizer funds. Payout timing is determined by Stripe.

6.7 Processing fees. Payment processing fees charged by Stripe are separate from the Platform Fee and are deducted from payouts unless we tell you otherwise.

6.8 Refunds, chargebacks, and disputes. Organizers are responsible for issuing refunds to Vendors and for all chargebacks, payment disputes, reversals, and related fees on their transactions. If we or Stripe incur a loss because of your transactions, including a negative balance, you authorize us to recover that amount by deducting it from future payouts, charging your payment method on file, or invoicing you.

6.9 Payments outside the Service. Organizers may collect some payments outside Turnout, such as cash or check. We are not involved in, and are not responsible for, any payment made outside the Service.

6.10 Taxes on Organizer Fees. Organizers are responsible for determining, collecting, and paying any taxes on Organizer Fees.

6.11 Non-payment. If a payment to us fails or is overdue, we may suspend your access to paid features until it is resolved.

7. Your Content

7.1 You own your content. You keep ownership of your User Content.

7.2 Permission you give us. You grant Widget Bot a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example, resizing images), display, and transmit your User Content only as needed to operate, secure, and improve the Service and to carry out your instructions. This license ends when your User Content is deleted from the Service, except for copies kept in backups for a limited time and content you have already shared with other Users, such as submitted applications.

7.3 Permission Vendors give Organizers. When you apply to a Show, you give the Organizer, its team members, and its Jurors permission to view, review, score, and keep your application, including your images, for purposes of that Show. If you are accepted, you also give the Organizer permission to display your name, business name, and application images to promote that Show, unless the Show's listing says otherwise.

7.4 Customer listing. Organizers allow us to identify them as a Turnout customer and to display their name and logo on our website and marketing materials. You can opt out at any time by emailing support@betterturnout.com.

7.5 Your promises about your content. You confirm that you have all rights needed to submit your User Content and that it does not infringe anyone's rights or break any law.

7.6 Feedback. If you send us ideas or suggestions about the Service, we may use them without any obligation to you.

7.7 Removing content. We do not pre-screen User Content, but we may remove any User Content that we believe violates these Terms or the law.

8. Acceptable Use

You agree not to:

  • use the Service for anything illegal, fraudulent, or deceptive;
  • list a fake Show, or collect money for a Show you do not intend to hold or do not have authority to run;
  • impersonate any person or organization, or misrepresent your affiliation with one;
  • upload content that infringes intellectual property rights, or that is harassing, hateful, threatening, sexually explicit, or otherwise objectionable;
  • send spam or unsolicited bulk messages;
  • scrape, harvest, or collect User information for purposes unrelated to your Shows or applications, or sell User information;
  • access another User's account without permission;
  • interfere with, disrupt, probe, or test the security of the Service;
  • reverse engineer the Service or use automated tools to access it, except through tools we provide for that purpose;
  • get around Turnout Fees or other restrictions;
  • upload viruses or other malicious code;
  • resell or sublicense the Service without our written permission; or
  • use the Service to build a competing product.

9. Our Intellectual Property

The Service, including its software, design, and content (other than User Content), and the Turnout, Gridget, The Widget Bot, and Netrork names and logos, are owned by Widget Bot, Netrork LLC, or their licensors. Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable right to use the Service. We reserve all rights not expressly granted.

10. Third-Party Services

The Service works with third-party services, such as Stripe. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

11. Privacy

Our Privacy Policy explains how we handle personal information. Organizers are also responsible for how they handle Vendor information, as described in Section 4.5, and should have their own privacy notice where required by law.

12. Suspension and Termination

12.1 By you. You may close your account at any time. Closing your account does not refund fees already paid, except as described in Section 6.4, and does not end your obligations for active Shows, including any refunds owed to Vendors.

12.2 By us. We may suspend or terminate your account, a Show, or your access to any feature if we reasonably believe you have violated these Terms, created a risk of fraud or harm to other Users, failed to pay Turnout Fees, or if we are required to do so by law or by Stripe. When reasonable, we will give you notice first. In cases of suspected fraud or serious risk, we may act immediately. If we suspend a Show because of suspected fraud, we may notify Vendors who applied to or paid for that Show.

12.3 Your data after termination. For 30 days after your account is closed, Organizers may request an export of their Show data by contacting us. After that, we may delete it, subject to our Privacy Policy and any legal obligation to keep records.

12.4 Survival. Sections that by their nature should continue after termination will continue, including Sections 3, 6.8, 7.3, 7.5, and 13 through 18.

13. Changes to the Service and These Terms

13.1 The Service. We may add, change, or remove features at any time.

13.2 These Terms. We may update these Terms. If we make a material change, we will notify you by email or in the Service at least 14 days before it takes effect, unless the change is required by law or needed to address a security issue. If you keep using the Service after the effective date, you accept the updated Terms.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WIDGET BOT AND NETRORK LLC DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE PRESERVED WITHOUT LOSS. WE ARE NOT RESPONSIBLE FOR USER CONTENT, THE CONDUCT OF ANY USER, OR ANY SHOW.

We strongly recommend that Organizers keep their own copy of essential Show information, such as Vendor lists and booth assignments, ahead of each Show day.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) WIDGET BOT, NETRORK LLC, AND THEIR AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST SALES, EVENT COSTS, OR LOST DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND

(b) THE TOTAL LIABILITY OF WIDGET BOT AND NETRORK LLC FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE TURNOUT FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100). ORGANIZER FEES PAID BY VENDORS TO ORGANIZERS ARE NOT AMOUNTS PAID TO US.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Widget Bot, Netrork LLC, and their affiliates, owners, officers, employees, and contractors from any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising from:

  • your use of the Service;
  • your User Content;
  • your Shows, if you are an Organizer, or your participation in Shows and the products you sell, if you are a Vendor;
  • your violation of these Terms, any law, or anyone else's rights; or
  • any dispute between you and another User.

17. Disputes

17.1 Talk to us first. If you have a dispute with us, please contact us at support@betterturnout.com and give us 30 days to try to resolve it informally before starting any formal proceeding.

17.2 Governing law. These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules.

17.3 Where disputes are resolved. Any dispute that is not resolved informally will be resolved exclusively in the state or federal courts located in the State of Michigan, and you and we consent to those courts' jurisdiction. Either party may instead bring an eligible claim in small claims court.

17.4 Individual claims only. To the extent permitted by law, you and we agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action.

17.5 Jury trial waiver. To the extent permitted by law, you and we waive any right to a jury trial.

17.6 Time limit. Any claim related to the Service or these Terms must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.

18. General Terms

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
  • Assignment. You may not transfer these Terms without our written consent. We may transfer them in connection with a merger, acquisition, or sale of assets.
  • Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet or hosting providers, natural disasters, or government action.
  • Notices. We may send notices to the email address on your account. You may send notices to us at support@betterturnout.com.
  • Electronic communications. You agree that notices and agreements we provide electronically satisfy any legal requirement that they be in writing.
  • Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
  • No third-party beneficiaries. These Terms do not give rights to anyone other than you and us.
